Kindred Circle — Terms of Service

Kindred Circle ("the app", "the service") is operated by Harms Tech LLC ("we", "us"), a Pennsylvania limited liability company. By creating an account or using the app, you agree to these Terms and to our Privacy Policy and Consumer Health Data Privacy Policy.

1. What Kindred Circle is — and is not

Kindred Circle is a consumer tool that helps family members and caregivers privately organize and coordinate care information for a loved one (medications, doses, meals, blood pressure, appointments, hospitalizations, schedules, posts, and contacts).

It is not medical software. Kindred Circle:

• is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition;
• is not a medical record and is not a substitute for professional medical advice, diagnosis, or treatment;
• does not provide medical advice. Always seek the advice of a qualified health provider with any questions about a medical condition.

In an emergency, call your local emergency number (911 in the U.S.). Do not rely on the app to summon help or to deliver time-critical information.

We are a consumer application and are not a HIPAA-covered entity or a business associate, and we do not enter into business associate agreements.

2. Eligibility

You must be 18 or older and able to form a binding contract to use Kindred Circle. The app is offered in the United States and is not directed to or offered in the EU/EEA or UK. It is not directed to children under 13.

3. Your account

You sign in with Sign in with Apple. You are responsible for activity under your account and for the accuracy of the information you enter. You may delete your account at any time in the app (Settings → Delete account); deletion is described in the Privacy Policy.

4. Acceptable use

You agree not to: use the app for anything unlawful; upload content you don't have the right to share; attempt to access another family's data or to disrupt, reverse-engineer, or overload the service; or use the app to provide professional medical services to third parties.

You are responsible for the content you enter and for having the right to share information about the person you are caring for with the family members you invite.

5. Subscriptions and billing

Some features may require a paid subscription. Subscriptions are sold and billed by Apple through your App Store account, subject to Apple's terms. Payment is charged to your Apple ID; subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Manage or cancel a subscription in your App Store account settings — we cannot cancel or refund Apple subscriptions on your behalf, and deleting your Kindred Circle account does not cancel a subscription. Any free-trial terms are disclosed at the point of purchase.

6. Content and ownership

You retain ownership of the content you enter. You grant us a limited license to store, process, and display that content to the family members you invite, solely to operate the service. We do not sell your content or use it for advertising.

7. Disclaimers and limitation of liability

The service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that information in it is accurate or complete.

To the fullest extent permitted by law, Harms Tech LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on the app for medical or care decisions. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim or US$50.

8. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service or its users.

9. Changes to these Terms

We may update these Terms; material changes will be reflected by the "Last updated" date above. Continued use after a change means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Pennsylvania, and you consent to their jurisdiction.
